By downloading, accessing, or using Storynite, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the app.
You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account. Storynite is designed for parents and guardians to create stories for children ages 2-12. Children should not use the app independently.

By creating a child profile, you represent that you are the parent or legal guardian of the child and consent to the collection and use of their information as described in our Privacy Policy.
Subscription Required: Storynite requires an active subscription to access app features. A subscription is required to create stories and access your library.
Available Plans:
Free Trial: Eligible new users may receive a 7-day free trial on the Family plan. Your trial begins when you start a Family subscription and automatically converts to a paid Family subscription unless cancelled before the trial ends.
Billing: You will be billed according to your selected subscription plan (monthly or annual). Prices may vary by region. Annual plans offer savings compared to monthly billing.
Cancellation: You may cancel your subscription at any time through your Apple App Store settings. Cancellation takes effect at the end of your current billing period. After cancellation, your account will be deactivated (see Section 9 for details about account deactivation and data retention).
Refunds: Refunds are handled by Apple according to their refund policies.
Plan Changes: You may upgrade from Spark to Family at any time. Upgrades take effect immediately with prorated billing.
Storynite uses artificial intelligence to generate story text and illustrations.
No Guarantee: We do not guarantee that AI-generated content will be error-free, appropriate for all audiences, or meet your specific expectations.
Content Review: While we design our AI to create age-appropriate content, we encourage you to review stories before sharing them with your child.
Your Responsibility: You are responsible for reviewing the generated content and determining its suitability for your child.
Limitation of Liability: We are not liable for any AI-generated content, including any content that may be inaccurate, inappropriate, or offensive. You use the AI-generated content at your own risk.
Input You Provide: You retain all rights to the information you provide (daily input, child details).
Generated Stories: Stories generated for you are for your personal, non-commercial use.
Story Export: Family plan subscribers may export their stories in PDF or ePub format. We encourage you to regularly export stories you wish to keep as a personal backup. Exported files are temporarily cached and then automatically removed from our servers.
Data Portability: Regardless of your subscription plan, you have the right to receive a copy of the personal data we hold about you in a structured, machine-readable format. To submit a data portability request, contact us through our website. We will fulfill your request within 30 days.
License to Us: By using our service, you grant us a limited license to process your input to generate stories and improve our service.
You agree not to:
Subscription Cancellation (Account Deactivation): When your subscription ends (either by cancellation or expiration), your account becomes "deactivated." During deactivation:
Data Retention Period: Deactivated accounts and all associated data are retained for 6 months from the date of deactivation. After 6 months, your data will be permanently deleted unless you have reactivated your subscription.
Early Data Deletion: If you wish to have your data deleted before the 6-month retention period:
Account Deletion By You: You may permanently delete your account at any time through the app settings. This immediately and permanently removes all your data.
Account Termination By Us: We reserve the right to suspend or terminate your account at any time, with or without notice, for:
Effect of Termination: Upon termination by us, your right to use the app ceases immediately. We may delete your data in accordance with our Privacy Policy.
We reserve the right to modify these Terms at any time. We will provide notice of significant changes through the app or via email to the address associated with your account.
Continued use of the app after changes constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the app and delete your account.
The app is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:
We do not warrant that the app will be uninterrupted, error-free, or secure.
To the maximum extent permitted by law, Storynite and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.
You agree to indemnify and hold harmless Storynite and its affiliates from any claims, damages, losses, or expenses arising from your use of the app or violation of these Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.
Any dispute arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive your right to participate in class action lawsuits.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Storynite regarding your use of the app.
